They invested years in marriage counseling and finally, after years of infertility, gave up and asked an adoption agency to give them a child. They were accepted and the three year old arrived at their doorstep. The husband named the child Madelyn. A year later she received a visit from two state social workers asking questions about her biological parents. They claimed there was a legal guardianship case. Despite the fact that she was a legally adopted child, after speaking with her teacher and new social worker it was decided that they needed to locate the two women that were petitioning to adopt her. By this time, it was clear to them that the adoption was a complete farce and the lesbian couple had no legal rights to this child. The social workers were ready to take action against them but they were sidetracked when a couple of men appeared claiming to be her parents. These men held press conferences and filed a lawsuit claiming that they were her biological parents. The gay couple were only interested in one thing, finding their biological child and they used every legal means to accomplish this goal. The court was pressured and threatened with a custody trial. Their lawyers said the case could ruin them financially. They were even arrested, beaten and put in jail for contempt. They were released but all hopes of finding their child were lost. On March 28, 1978, the Massachusetts Supreme Judicial Court ruled in favor of the legal guardianship and for Madelyn Wood these issues were never to be discussed again. They lost the child and they lost the child, the court ruled. Wood was adopted by her lesbian parents and made a part of the family. Shortly before the Supreme Court's decision, the adoption was finalized and the adoption agency gave notice to the family that the child had been legally adopted. For the next 30 years the lesbian couple fought for permission to have custody of their daughter. They were never contacted by the adoption agency, their lawyers or their daughter's parents. After the Supreme Court's decision, the couple sued the adoption agency, claimed they had a contract and had a right to custody of their child. Finally, they were found and their lawyers appeared on television broadcasting the entire case. The family, the lawyers, the court officials and the entire nation all watched with interest. 595f342e71
